Do you need to apostille your Power of Attorney (POA)?

An apostille on Power of Attorney is always obtained in the same state where your document was signed and notarized. So, if you signed and notarized your Power of Attorney in New York, your POA can only receive an apostille from the State of New York.

Before you apply for an apostilled POA check if a country where your POA will be used is a member of the Hague Apostille Convention. Power of Attorney apostille can only be obtained on documents going to the member-country of the Hague Apostille Convention. If you plan to use your POA in a non-member country of the Hague Convention, your Power of Attorney will receive an Authentication State Certification instead of an apostille. Authentication Certificate on Power of Attorney intended for non-member countries of the Hague Convention will require the US Department of State certification and legalization from the Embassy/Consulate.

It is advisable to hire an attorney practicing in a country where you need to use your POA to ensure its accuracy in accordance with the laws of that country.  So, if, for instance, your Power of Attorney is intended for Russia, we recommend that a Russian attorney prepares your document. Choosing an experienced attorney from a country where your POA will be used can help you avoid potential errors and rejections.  Also, it will be helpful to prepare Power of Attorney in both languages. For use in Russia, for example, your Power of Attorney will be prepared in English and Russian.

If your POA initially was prepared in a foreign language, we recommend having it translated into English. A Power of Attorney executed in a foreign language will be acceptable for most states as long as your document has been signed, notarized, and attested with a proper English notarial affidavit.

A Power of Attorney should always be notarized by a local public notary and attested with the proper State notarial affidavit in English before it can be submitted for an apostille.
