Do you need to receive an apostille on your Power of Attorney?

An apostille on a Power of Attorney is required when one has a business or personal matter in a member-country of the Hague Apostille Convention. An apostilled Power of Attorney is a document delegating your business/personal matters to a trusted individual abroad, so that you don’t need to travel to that country yourself. For example, if you need to sell your property in Mexico but can’t travel there to deal with the sale yourself, you can appoint a family member or another individual to handle the sale on your behalf. 

To apostille a Power of Attorney, you need to mail an original notarized document to our office. Remember that an apostille on Power of Attorney is always processed in the same state where the document was created and notarized. Make sure a notary public you select is licensed and knowledgeable on notarial laws in your state. 

A Secretary of State can only authenticate documents issued in that state. In other words, if your Power of Attorney was notarized in the State of California, an apostille on it can only be issued by the California Secretary of State. Some states, including Hawaii, Kentucky, Maryland, New York, and Tennessee, require that the notarized Power of Attorney is also authenticated by the County Clerk before it can be submitted for an apostille.
